Terms of Service
By engaging in any commission or collaboration with Surya Baswara ("Artist"), you ("Client") agree to the following Terms of Service. These terms govern the relationship between the Artist and the Client and constitute a binding agreement.Commissioned Artwork:
1.1 Artistic Style and Expectations:
The Artist specializes in digital fantasy character illustrations. The Client acknowledges the Artist's style and understands that the final artwork will reflect the Artist's interpretation.1.2 Project Scope:
The Client agrees to provide a detailed brief and description for the commissioned artwork. The Artist will review the brief and provide a price quote.1.3 Pricing and Payment:
Payment Methods: Payments are accepted via PayPal and other commission service providers as agreed.
Payment Structure: A deposit of 50%-100% of the agreed price is required before work begins. The balance is due upon completion and before final files are delivered.
Currency and Fees: All prices are in USD. The Client is responsible for any currency conversion and transaction fees.
Workflow Stages:2.1 Timeframe:
Completion of the artwork typically takes 14 to 40 days, depending on project complexity and the Artist's workload.2.2 Revisions:
The Client is entitled to 2 revisions during the thumbnail and preliminary sketch stages. Additional revisions may incur extra fees.2.3 Updates:
The Artist will provide progress updates every stages finished.Intellectual Property:
3.1 Ownership:
The Artist retains full ownership and copyright of the commissioned artwork unless otherwise agreed in writing. The Client receives a limited license for personal use and may not reproduce, resell, or use the artwork for commercial purposes without prior written consent.3.2 Client's Obligation to Credit:
The Client agrees to credit the Artist in any public display or usage of the commissioned artwork.3.3 Artist's Rights:
The Artist reserves the right to showcase the artwork in their portfolio and promotional materials unless the Client explicitly requests otherwise.Confidentiality and Privacy:
Both parties agree to treat all project-related information confidentially. The Artist will not disclose any personal or sensitive information shared by the Client without explicit consent, except as required by law.Deliverables:
Upon completion, the Artist will deliver:
Softcopy files in the form of JPG file, PNG file, and PSD file
Refund Policy:
6.1 Deposit Refund:
The deposit is non-refundable once work begins. If the Artist is unable to complete the commission, a full refund of the deposit will be provided.6.2 Balance Refund:
No refunds are issued once the final payment is made and the final files are delivered.Commercial Use:
The Client may request merchandising rights for an additional fee, allowing the commissioned artwork to be used for commercial purposes.Miscellaneous:
8.1 Force Majeure:
The Artist is not liable for delays or failures due to causes beyond their control, such as natural disasters or government actions.8.2 Amendments:
The Artist reserves the right to amend these Terms of Service at any time, with notification to the Clients.Acceptance of Terms:
By proceeding with any transaction, commission, or collaboration, the Client acknowledges and agrees to these Terms of Service.
